Novelist — Terms of Use

These terms govern your use of the Novelist iOS app. In short: Novelist helps you write stories with AI assistance and gives you a library of ready-to-read stories. The stories you create are yours; the words an AI model writes for you are, like any AI output, not guaranteed to be accurate, original, or suitable for every purpose.

1. Agreement

These Terms of Use are a legal agreement between you and Abdullah Al Hadi (publishing as Mukashi) ("we", "us"), governing your use of the Novelist app. By using the app you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the app.

2. What Novelist is (and isn't)

Novelist is a creative-writing tool that uses third-party AI models (via Anthropic's Claude API) to generate chapters, plot continuations, and story text based on the options and characters you provide, plus a bundled Discover library of pre-written stories. Novelist is not a fact-checking, research, news, legal, medical, financial, or professional-advice service. AI-generated text is produced by a language model and may be inaccurate, repetitive, biased, out of character, or otherwise imperfect — treat all generated content as fiction and review it before you rely on, publish, or share it.

3. Eligibility & licence

You must be at least 13 (or the minimum age of digital consent where you live) and able to form a binding contract. We grant you a personal, limited, non-transferable, revocable licence to use one copy of the app on Apple devices you own or control, for your own non-commercial or commercial use of the stories you create, under the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or sublicense the app itself except where the law permits despite this restriction.

4. Subscriptions & payments

Novelist is free to download. Starting a story and generating a limited number of chapters and regenerations is free; beyond that free limit, continuing requires Novelist Pro, an auto-renewing subscription offered in weekly, monthly, and yearly terms. For each option, the length and current price are shown in the app before you buy, and payment is charged to your Apple Account at confirmation of purchase.

5. Your content

The stories, characters, and other input you create in Novelist — and the chapters generated for you — are your content. Where AI-generated text is not eligible for copyright protection under applicable law, we make no claim to it and you're free to use it as you wish. To run the service, you grant us the limited right to transmit the story/character details and instructions you provide to Anthropic's API to generate the output you requested, and to store your story content on our backend so it can be generated, continued across sessions, and returned to you, as described in the Privacy Policy. You are responsible for the prompts (genre choices, character details, Fine-Tune/Redirect Plot text) you provide and for reviewing generated output before publishing, sharing, or relying on it — including checking it doesn't infringe someone else's rights or make false factual claims.

6. Acceptable use

You agree not to use Novelist to generate or attempt to generate content that is illegal, that sexually exploits minors, or that is intended to harass, defame, or seriously harm a real, identifiable person; not to use generated content as if it were factual, professional, or legal/medical/financial advice; not to attempt to abuse, circumvent, or automate around the free-tier limits, rate limits, or the anonymous-account system; and not to reverse-engineer, scrape, or interfere with the app or its backend.

7. Disclaimer & limitation of liability

The app and all AI-generated content are provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We do not warrant that generated content will be accurate, original, non-infringing, uninterrupted, or error-free, or that your stories will always be preserved without loss — export or back up anything important. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of or reliance on generated content; our total liability will not exceed the greater of what you paid for Novelist Pro in the prior 12 months or USD 10. Some jurisdictions don't allow certain exclusions, so parts of this may not apply to you.

8. Termination & changes

You may stop using the app any time by deleting it. We may suspend access if you materially breach these terms, including the acceptable-use rules in Section 6. We may add, change, or remove features (including free-tier limits and AI model tiers), and may update these terms; material changes will be noted in the app's release notes, and continued use means you accept the revised terms. Sections that should survive termination (content licence, disclaimers, liability) continue to apply.

9. Governing law

These terms are governed by the laws of Bangladesh, without regard to conflict-of-laws rules, and the courts of Bangladesh have exclusive jurisdiction — except where mandatory local consumer-protection law lets you bring proceedings in your country of residence.

10. App Store (Apple) terms

Because you obtained Novelist through Apple's App Store: these terms are between you and us, not Apple, and Apple is not responsible for the app; Apple has no obligation to provide maintenance or support; if the app fails to conform to any warranty you may notify Apple, who may refund the purchase price, and Apple has no other warranty obligation; we (not Apple) are responsible for any product-liability, legal-compliance, or intellectual-property claims relating to the app; you confirm you are not in a U.S.-embargoed or prohibited-party jurisdiction; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
