DeSpark — Terms of Use

Effective date: August 1, 2026

These terms are the agreement between you and the developer of DeSpark. They're written in plain English on purpose. The separate Privacy Policy explains what data the app collects.

By downloading or using DeSpark, you agree to these terms. If you don't agree, please don't use the app.


The short version

DeSpark cleans your photos and videos on your device. You keep your content — we never receive it, so we never own it or license it.

The app is free with ads, and an optional Pro purchase removes them. Clean only content you have the right to modify — don't use DeSpark to strip someone else's watermark or credit. Automatic cleanup is a best effort, not a guarantee, so keep your originals.


1. Who these terms are with

DeSpark ("the app") is developed and operated by Abdullah Al Hadi ("we", "us", "our"). You can reach us at mukashi.dev@gmail.com.

These terms cover the DeSpark app on iOS, iPadOS, Android, and macOS, including its Share Extensions.


2. Who can use DeSpark

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use DeSpark. If you're under 18, you should have a parent or guardian's permission — especially before making any purchase.


3. What DeSpark does

DeSpark removes unwanted objects, marks, and distractions from photos and videos. All detection and editing run on your device. Nothing is uploaded for processing, and we operate no server that stores your content.

Because the work happens locally, results depend on your device — its speed, memory, and free disk space. Large images and long videos take longer and need more space.


4. Your content stays yours

You keep all rights to the photos and videos you clean. We claim no licence and no ownership over them — and we couldn't, because your content never reaches us. It stays on your device unless you choose to share or export it yourself.

The one exception is a bug report you send us by email with an image attached. If you do that, you're giving us permission to use that image only to reproduce and fix the problem you reported. We don't use it for anything else.

You are responsible for your content: for having the right to use and modify it, and for what you do with the result.


5. Acceptable use

DeSpark is a tool for cleaning up your own pictures, or pictures you otherwise have the right to edit. You agree not to use DeSpark to:

We may stop supporting your use of the app if you break these rules. Since the app runs on your device and we hold no account for you, enforcement in practice means we may decline support and, where a store policy applies, report the misuse to Apple or Google.


6. The free version, ads, and limits

DeSpark is free to use, funded by ads from Google AdMob. In the free version you may see a home-screen banner, occasional full-screen ads, an ad when you open the app, and an optional rewarded ad you can choose to watch to unlock a feature for a limited time. Watching a rewarded ad is always your choice — you can decline and either skip the feature or buy Pro.

Some features may be subject to limits (for example a cap on how many items a batch can hold, or a daily cleanup allowance). Which ads appear, how often, and what the limits are can be adjusted remotely without an app update, as described in §3 of the Privacy Policy. We may change, add, or remove free-tier limits over time.

Ads are supplied by third parties. We don't control which specific ads you're shown and we don't endorse them.


7. Pro — subscriptions and the lifetime purchase

Pro is optional. It removes all ads and unlocks the app's power features. There are two ways to buy it, and both unlock the same thing:

Prices. The price shown in the app at the time of purchase is the price that applies. Prices vary by country and may change over time; for a subscription, we'll give you notice through the store before a price increase takes effect, and you can cancel if you don't accept it.

Payment and billing. All purchases are processed by Apple (App Store) or Google (Google Play) — not by us. Payment is charged to your store account at confirmation of purchase.

Auto-renewal. A weekly subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours of the end of the period.

Cancelling. You manage and cancel a subscription in your store account settings — App Store: Settings → your name → Subscriptions, or Google Play: Menu → Subscriptions. Deleting the app does not cancel a subscription. Cancelling stops future renewals; it doesn't shorten the period you've already paid for.

Restoring. The lifetime purchase is tied to your store account. Use Restore purchases in Settings to bring it back on a new device or after reinstalling. Restoring requires the same Apple or Google account used to buy it.

Refunds. Refunds are handled by the store, under Apple's or Google's refund policies. We can't issue refunds ourselves, but if something's wrong, email us at mukashi.dev@gmail.com — we'll help where we can.

On Apple platforms, Apple's Licensed Application End User Licence Agreement also applies to your use of the app, and prevails over these terms wherever the two conflict.


8. Keep your originals

DeSpark's automatic detection and cleanup are a best effort, not a guarantee. Depending on the picture, the app may miss a mark, remove only part of it, or alter an area you didn't intend to change. Video is re-encoded when it's exported, which can change quality, colour, or file size.

Please keep your original files. Save the cleaned result as a new file rather than replacing an original you can't recover, and check the result before you delete anything. We're not responsible for content you lose or overwrite.


9. Availability and changes to the app

We may update, change, suspend, or discontinue DeSpark or any of its features at any time. Features can also be switched on or off remotely, as described in §6. We'll try not to break things you rely on, but we can't promise the app will always be available, compatible with every device, or free of bugs.

If we discontinue the app, purchases already made are governed by the store's policies.


10. Third-party services

DeSpark uses services from Google (Firebase, AdMob), RevenueCat, Apple, and Google Play. Your use of those services through the app is also subject to their own terms and privacy policies, which are listed in §10 of the Privacy Policy. We're not responsible for third-party services or content.

The app includes open-source software used under its own licences. You can read the notices in Settings → Open-source licenses.


11. Disclaimer of warranties

DeSpark is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We don't warrant that the app will meet your requirements, that any particular mark or object will be detected or removed, that results will be of any given quality, or that the app will run uninterrupted or error-free.

Some jurisdictions don't allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits any rights you have as a consumer under the mandatory law of your country.


12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, profits, or goodwill, arising out of your use of — or inability to use — DeSpark.

To the fullest extent permitted by law, our total liability for any claim relating to DeSpark is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or USD 50.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.


13. Indemnity

You agree to indemnify us against claims, damages, and reasonable costs arising from your misuse of the app or your breach of §5 (Acceptable use) — for example a claim brought by a rights holder over content you altered without permission.


14. Ending these terms

You can end this agreement at any time by deleting the app. We may end it if you materially breach these terms. Sections that by their nature should survive — §4 (your content), §11, §12, §13, and §15 — survive the end of this agreement.


15. Governing law

These terms are governed by the law of the country where you live, and any dispute can be brought before your local courts.

Where your country's consumer law gives you rights that these terms cannot limit, those rights apply regardless of anything written here.


16. Changes to these terms

If we change these terms, the new version replaces this page at https://hadicuet.github.io/despark-legal/terms.html and the "Effective date" above is updated. Material changes will be called out in the app's release notes. Continuing to use the app after a change means you accept the updated terms.
